If you settle on a set amount initially about child custody, support, and the financial support can it change later when situations change? Like right now I would like to split custody as 50/50 as possible and the debt and not have child support so that my husband can be close enough to our kids to have a relationship with them. However, later if he becomes more financially capable I would like him to take back more of the debt (considering it is almost all his). And possibly pay some child support as I will most likely end up having the kids more than 50/50 but no support if it is an even split. Is that something that can be assessed at a later time as our circumstances change?

Well, I went to the prison as she was getting off 2:30PM, I tried to speak to her and gave her my sons panda bear back. She said Oh Shit as I walked up, and I’m not sure what she has told her co-workers, but there was about 12 of them around me in less then 20 seconds telling me they were going to call the police. I have NEVER been physically abusive in any way toward her and she acts as if she is frightened of me. Maybe she is scared of her feelings, I don’t know, but I know I feel as if I am nothing more to her then an ex-babysitter. It hurts so bad, I am dieing inside. I have to accept she has found a man with no injuries, a truck, a house and money so she is happy and doesnt need me anymore. I am going to church, work my job and pray for them daily. I hope they are treated well and who ever he is takes care of my son. I wish life would stop, but sadly it will not. Thanks for all your advice please keep us in your prayers. The Father is ordered to provide and is providing full medical and dental coverage on his child until the Child finishes college. The monthly out of pocket exspense, after his employer conttribution is $200.00. Which was levied, by DCHS. The mother is to pay any non covered expense. With no regard to the dental plan and the participating provider network, the mother chose to take him to a non participating Dentist The father did not find out til after the fact, when he recieved a bill from the dentist for $860.00. The plan requires pre authorization. Delta Dental did pay $ 680.00 to a non participating provider, leaving a balance of $180.00 which the mother refused to pay and provided all personal info to Dentist, which now turned it over to a Collection Agency. This is 1 of many issues.

The Marriage Settlement Agreeement states that I will be the person solely responsible for this debt and I hold the STBX harmless.

When I file Ch 7 to discharge the RV loan, car loan and credit cards, can they still go after her amnd hold her liable? Even though the MSA says that I am the resposible party and the debt is in my name only?

We filed for a summary dissolution last year and at the time, the credit card balance was under the 6 grand that is the max amount of debt you can have together based on California law. In oru property settlement agreement, we signed off on it by saying that husband and wife will pay off the joint credit card jointly until it is paid off. Upon final payment, account will be closed out. Since then more charges have been put on it until it finally got closed out. Now there is a balance on it over 6 grand and he refuses to pay on it. I’m paying on it alone and I’m wondering… Because the property settlement agreement didn’t say how much each would pay or that it would be split in half, if he just pays one cent, does that mean he did his part and I have to pay the rest? My husband has created fraudulent debts to make it look like I cannot cash out the equity in our home. Its a long story and has cost me over $4k in attny fees to get awarded very basic equity that he wants to make in structured monthly payments. There is a clause in my divorce papers that says bankruptcy is not an release for this debt. However, he has already made it clear he has no intention of making any of the monthly payments. His checking acct is continually overdrawn and he rarely pays banks and creditors on time, so there is little reason to believe I will get my money. I am wondering what experience you have to help me? I have requested a lein on the house (he wants it), an insurance policy or some other penalty be attached to non-payment, I also suggested there be a bonus for regular monthly payments (say a $1000 less owed). But my attorney has not responded to any of these saying he has to pay. But I know better. What did you do to protect yourself?
