Now they want me to sign a stipulated judgement saying that I will pay interest on the debt until its paid. the plaintiff’s attorney said to me in an email “As you know, you accepted our settlement offer of $5,000. If you had paid that sum in one lump payment upon that acceptance, there would have been no interest. However, since you are making payments, interest accrues under Washington law at the rate of 12% per annum.” is this true? do i have to pay interest by law because i’m paying monthly?

I contacted the lawyer and I was told that they mailed the bill collectors a check for less than what is owed and if they were to cash it ( which they did) then they are accepting it as payment for total debt, but they still keep billing me. In our thirties and with two babies in tow, my husband I built onto our first home. We pick-axed the trench, poured concrete, hammered thousands of nails, lifted 2 by 4’s; nailed window headers, installed a full bath, lifted tar rolls and shingles to the new roof, spackled, painted. That two-year process was back-breaking work, but my children got rooms and we began to grow financially. I remember my children saving their Christmas and birthday money in Bank of America, $15 dollars at a time. I was teaching them the value of saving money. Each child got their accounts up to $85.00. Bank of America never told me that the accounts had to be at least $100. So, my children’s gift money from relatives was taken by Bank of America. So began my lessons with Bank of Amevil. Years of viciously tremendous MBNA interest fees never allowed us to decrease our debt with them. While MBNA made 100% profit for years on all of our payments, our balance just kept increasing.

When we bought our final house, National City Mortgage held the loan. You can do all of the research you’d like in order to make an informed decision, but in the end, you will probably go with the advice of the “experts.”

In 2007, my husband and I lost our home, all of our retirement, had to sell a car, moved three times within a year, sporadically go grocery shopping and usually have 10 or 2 items in the fridge, have ceased purchasing clothes even at the thrift shop, have canceled home phone, internet, my cell. Two bankruptcy attorneys told me that we could have easily qualified for full bankruptcy. My husband has been laid off. But for moral reasons, rather than make creditors eat all of the loans, we entered debt settlement.

Now in our fifties, we have started new. No longer with Bank of Amevil, our new credit life with this bank has been honorable. When we opened the account, they offered overdraft protection, which we have used. We make heroic efforts to pay it back. We’d like for our banking history with this bank to based on our clean, timely payments. We constantly sweat the threat of overdrafts, just making it by pennies. This is a long, slow, painful, extremely stressful process, but we are trying and doing moral best.

However, this new bank found out about our settlements with past creditors, which have nothing to do with the new history we have established, like paying large amounts at a time back for the use of the overdraft protection. With no warning, this bank lowered our overdraft protection and set into motion the likelihood of bounced checks, this time with the creditors with whom we have agreed to settle. Aside from the unethical dilemma in which this bank created for us, the new life of showing prompt payments and good faith, and now future creditors and those who check credit, potential employers, housing, it has been sorely damaged, again.

This unethical treatment of banks preying on those of us who are trying to rebound from losing everything and reestablish our lives must stop immediately.

When I got my undergraduate degree, I read of one theory as to why the ancient Roman Empire fell: their greed.

Corporate greed has long been out of control. Corrupt CEO’s and lobbyists are not only not penalized, they are somehow tremendously rewarded. But morality is not. Morality does not enter into their business practice with customers, though many customers, such as ourselves, use morality to guide our dealings with others, even businesses.

It is a shameful comment on our society that the business world has sentenced us to a legacy of immoral, abusive people.

The greedy have made it clear that money is the only language to which they will respond. Withdrawing it is the only pressure that may force them to stop these perpetrators. Good heavens, Chase charges monthly fees to just check your balance.

There was no insurance at the time of the wreck
Is the bank not liable at all for not picking up the truck when it was still in good working condition after me telling them where to locate it over 8 months?

We settled for various reasons, one of which my attorney was in the middle of losing his license and I would have had to start the process all over with a new attorney had I chosen to go to trial. I was required to make my first payment in the settlement 60 days later for an amount larger than what I had in my bank account or g=could immediately access. Therefore my husband and I applied for a second on our home. Once approved, which took longer than the 60 days before my 1st payment due, I paid the plaintiff’s attorney the first two payments due, therefore we were caught up. This was Dec 2006, and after that I continued to execute a payment each month in the agreed $1000 per month payment. In February 2007 the plaintiffs attorney filed an abstract of judgement unbeknownist to me until May 2007, when I received notice from the clerk -recorders office that a lien was being place on my property for much more than the remaining balance owed on the judgement. Then in July I received a letter from my bank stating that my joint bank account had a levy against it.
I tried to get help from the Orange County Courts office only to be told I didn’t qualify for any assistance, even to merely ask questions on what I needed to do to fight all of this. The only thing I have been told is I need to hire an attorney again and pay more money to fight all of this. I have paid this debt as agreed all along withthe exception of the 1st two payments while I was trying to get approved for a 2nd loan on my house. Once that was done all payments were caught us and since been paid every month. The x- employer and his attorney will not respond to any letters I have written asking why they are doing this, to release this and all payments have been made. I was led to believe that even though the initial payment was late because it was caught up and paid as agreed moving forward it was fine. Now they are trying to come up with ridiculous charges and fees and more money that I do not have to spend.
I went to the small claims court to try to file a small claims suit or counter suit or notice to vacate only to be told I can’t and I don’t understand why. I can’t seem to file anything without an attorney. I don’t have that kind of money again to go through all of this. I just want to prove that I have paid all along, have my day in court to show this so that this stops. I am $3000 away from being done with all of it, but now they are claiming I owe $10k+. What can I do?

P.S. Most of the Silver Spoons I saw had Rick Schroeder in them, heh. I know for a fact that frivolous lawsuits work, we have someone where I work who they are afraid to fire simply because of the ‘potential’ she will sue them, so what did they do, they allowed her to work a lower level job at her normal manager pay, that is fair, right?

I never try to defend myself against someone claiming to be ‘educated’, they frighten me too much, really they do.

All I am saying is that this don’t play Tag anymore because fat children will always be it mentality is making us a bunch of whiny sue happy cretins.

I was just trying to make two points, one, if you even mention race to some people, they immediately see that as the issue, when I didn’t even focus on that in my argument. And, two, we are in serious need of a wake up call with all these lawsuits.

To me, a boycott speaks louder than a lawsuit, because you have to actually put forth some effort, thus I know you are serious.

But once they got the notice from my settlement company that the accounts are in settlment they stopped. Except one. Nobody is perfect so yes I owe money on 2 separate cards. I was notified last week from a collections agency about the debt. Since then I have offered on several occasions to pay what I could afford until the debt is paid off, they keep rejecting it and demand payment well over what I can afford.
I have also been belittled and yelled at by one person to the point that I was in tears. I had even spoken with his supervisor whereby he told me that they are not customer service and they are jerked about by people all day. Does that give anyone an excuse to yell and redicule anyone?
I have also asked numerous times to be sent documentation of the debt and what they are proposing as settlement. They refused everytime. They have also requested a post dated check that they would deposit in 2 weeks.
The big question is this, if the agency refuses my payment does that deem the debt null and void?

A pt broke their hip as a result. The co never appeared in court, or thier INSURANCE co, and eventually went the DEFAULT status, they STILL never attended. Judge ruled in our favor for X amount of dollars (4 months ago).
My lawyer has requested amt to be paid which went ignored.. Lawyer has also requested a lein on payments to this company from Medicaid and our states insurance companies….now they have been instructed to SELL their property and send my lawyer the proceeds.
If they REFUSE this as well and file chapter 13, whatever it is…will our settlement be dismissed like a credit card debt?
I have asked my lawyer but he has not responded yet.

My exgirlfriend filed a civil lawsuit against me several years ago. Her, along with her two attorneys, thought I would settle out of court (they had no evidence and were pretty much attempting to extort money). When we refused to settle, they dragged out the case for as long as they could. I have expensive attorneys, and as you could imagine, my legal bills were high. Well, I have just been rewarded attorney’s fees to the tune of 150K. This was decided by the Supreme Court. My attorneys said that we will put liens on their (the plaintiff AND her attorneys) assets in order to collect the fees. First of all, what is the likelihood of me getting my money back? Second, could her attorneys face any disciplinary action for not paying their debts?

Any advice would be much appreciated!
Quick update: I have already paid my attorney. He is done collecting and wont receive any further compensation.
