Some one else was at fault however their insurance is still investigating the accident. Having just taken out a morgage and the settlement offered by my company going entirely to pay off the car loan, do i have any way of getting a car at the same value, and same interest rate with this total lose settlement. The bank has already said they cannot approve me for a loan based on my current debt, but credit score is still above 700. I live in ohio.

I am still making finance pmts, but just came into a lump some of money. Would it be possible to offer the finance company a settlement since the load is basically unsecured? I owe 8k and would be willing to pay 4k. I would threaten to stop paying (I wouldn’t actually stop) since the debt is unsecured and they have nothing to repo. Any better ideas?

The accident was in Maryland. The amount they are offering, $5K, is exactly enough to cover medical costs and lost wages. The reason I have a lawyer is that my girlfriend, who was the driver in our no-fault accident, was injured, needed knee surgery and still has back problems.

My question is, do you normally receive just enough to cover expenses or do they factor in a few more bucks for your troubles (pain suffering, etc)?

I live in Michigan. Got in an accident in ‘06. Had no insurance. Paid off my tickets made $200 payments to the collection agency for 2 years for $5000 or so worth of damages. Some of the damages werent my fault, but were tacked on just because. I was told that I couldnt do anything about that because i lost my voice when I drove with no insurance. Upon legal advice I asked for was promised a settlement and I asked for it in writing. I never got it. This was January 22nd. In the midst of that, I wasn’t able to and cannot afford the $200 because I had to get a new car. I can barely afford that, still no settlement papers. Today I come home and there is a card on my door saying I have legal papers to claim and to call for pick up. I dont know what to do. I dont want to go to court. I can’t afford the $1700 debt let alone court costs. I was told that my license can be taken from me. Someone HELP! ASAP! I’ve tried legal aid and defenders of michigan and they arent really helpful
